The executive branch
The executive branch of the People's Republic of China consists of the State Council, and the President (and Vice-President) of the PRC.
The State CouncilThe State Council (the Central People’s Government) is the executive body of the highest organ of state power.
Term: 5 years, and no Premier, Vice-Premier or State Councillor shall serve more than two consecutive terms. The State Council is composed of:
The Premier assumes overall responsibility for the State Council's work and directs the work of the State Council. The functions and powers of the State Council:
The State Council is responsible and reports on its work to the NPC or, when the NPC is not in session, to its Standing Committee. |
The President of the People's Republic of ChinaThe President of the PRC promulgates laws, appoints or removes the Premier, Vice-Premiers, State Councillors, Ministers in charge of ministries or commissions, the Auditor-General and the Secretary-General of the State Council; confers State medals and titles of honor; issues orders of special pardons; proclaims entering the state of emergency;proclaims a state of war; and issues mobilization orders.
Election: The President and Vice-President of the People's Republic of China are elected by the National People's Congress. Term: 5 years, no more than two consecutive terms Qualifications for President or Vice-President:
The Vice-President of the People's Republic of China assists the President. Vacancies: In the event that the office of the President falls vacant, the Vice-President succeeds to the office of the President, just like in the United States In the event that the office of Vice-President falls vacant, then the NPC elects a new Vice-President. In the event that both the officers of President and Vice-President fall vacant, then the NPC elects a new President and Vice-President. The Chairman of the Standing Committee temporarily acts as the President of the PRC. |
